2. Object
These general terms and conditions govern the online sale of tactical equipment, clothing, accessories, and airsoft replicas (hereinafter, the "Products") through the italytacticalshop.it website. Placing an order implies full acceptance of these terms and conditions.
3. Age requirements
The sale of airsoft replicas is reserved exclusively for adults (18 years of age or older). By placing an order for airsoft replicas, the customer declares under his or her own responsibility that he or she is of legal age. The Seller reserves the right to request a copy of an identity document and to cancel orders for which this requirement is not met.
4. Features of airsoft products
The airsoft replicas sold on the site comply with Article 5 of Law 110/1975 and applicable regulations: they have a muzzle kinetic energy not exceeding 1 joule and are equipped with a red cap or colored end cap where applicable. The replicas are not weapons and do not require a firearms license, but their improper use (carrying in a public place without a valid reason, removing the red cap, or modifying the power) may constitute a crime. The customer is solely responsible for ensuring that the purchased products are used in accordance with applicable laws.
5. Orders and conclusion of the contract
The order submitted by the customer constitutes a purchase offer. The contract is concluded upon the shipping confirmation sent by the Seller via email. The Seller may refuse or cancel orders in the event of: subsequent unavailability of the product, obvious pricing error, incomplete information, or suspected fraud. In the event of cancellation, any amounts already paid will be fully refunded.
6. Prices
All prices are in euros and include VAT. Shipping costs are indicated separately before order confirmation. The Seller reserves the right to change prices at any time; orders are subject to the price displayed at the time the order is placed.
7. Payments
The following payment methods are accepted:
- PayPal
- Bank transfer
- Cash on delivery (€5 supplement on shipping costs)
In case of bank transfer, the order will be processed upon receipt of the payment.
8. Shipping and delivery
Shipments are made from Italy via SDA/BRT. Times and costs are detailed on the page. Shipping and ReturnsDelivery is considered complete when the goods are made available at the address indicated by the customer. Upon receipt, the customer is asked to check the integrity of the package and report any damage to the courier with a written reservation.
9. Right of withdrawal
The consumer has the right to withdraw from the contract within 14 days without giving any reason, as detailed on the page Right of Withdrawal, which forms an integral part of these conditions.
10. Legal guarantee of conformity
All Products are covered by the 24-month legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code. In the event of a lack of conformity, the customer has the right to have the product restored through repair or replacement, or, where applicable, to a price reduction or termination of the contract. The defect must be reported to info@italytacticalshop.it. The guarantee does not cover defects resulting from improper use, modifications, or normal wear and tear (e.g., hop-up rubber tips, batteries subject to wear and tear).
11. Responsibility
The Seller is not responsible for damages resulting from improper or illegal use of the Products, nor for delays or failures due to force majeure.
12. Dispute Resolution
For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction. Consumers can also use the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr
13. Applicable law
These conditions are governed by Italian law.
